Define Exclusive Agency in Real Estate

Exclusive Agency: 

"Exclusive Agency" is a special agreement between a property owner and a real estate agent, where the agent gets paid a commission if they or another agent find a buyer or renter for the property, but not if the owner finds the person themselves. It's like having a helper who gets a reward for finding someone to buy or rent your place, but you don't have to pay them if you do it on your own.

Example: 

For example, a homeowner hires a real estate agent under an exclusive agency agreement to sell their house. If the agent or another agent finds a buyer, the listing agent earns a commission. However, if the homeowner finds the buyer on their own, the listing agent doesn't receive a commission because the agreement protects the agent's commission only against sales by other agents, not by the property owner themselves.

Scenario 1 (Exclusive agency applies):
A homeowner hires a real estate agent under an exclusive agency agreement to sell their house. The agent works diligently to market the property and find potential buyers. Eventually, another agent brings a buyer who is interested in purchasing the property. The sale goes through, and the listing agent earns their commission because they had an exclusive agency agreement in place.

Scenario 2 (Exclusive agency does not apply):
A homeowner signs an exclusive agency agreement with a real estate agent to help sell their property. The homeowner then decides to host an open house by themselves. During the open house, the homeowner meets a potential buyer, and they agree to move forward with the sale. In this case, the listing agent does not receive a commission because the homeowner found the buyer on their own, and the exclusive agency agreement does not cover this situation.

Scenario 3 (Exclusive agency applies):
A property owner lists their property for rent with a real estate agent under an exclusive agency agreement. The agent advertises the property and conducts showings. A different agent from another agency finds a tenant for the property, and the tenant signs the lease. The listing agent is entitled to a commission because another agent found the tenant, and the exclusive agency agreement is in effect.

Scenario 4 (Exclusive agency does not apply):
A homeowner hires a real estate agent under an exclusive agency agreement to sell their house. The homeowner's friend visits and falls in love with the house. The friend decides to buy the property directly from the homeowner. In this situation, the listing agent does not receive a commission because the homeowner found the buyer themselves, which is not covered under the exclusive agency agreement.
